Privacy Policy

This Privacy Policy explains how we process personal data in connection with our activities and operations, including our website.

In particular, we provide information about which personal data we process, for what purposes, how and where we process it. We also provide information about the rights of individuals whose data we process.

Additional privacy policies and other legal documents such as General Terms and Conditions (GTC), Terms of Use or Terms of Participation may apply to individual or additional activities and operations.

1. Contact Information

Responsibility for the processing of personal data:

Weyrauch Investment AG
Unterbrüglenweg 2
6340 Baar
Switzerland

We will indicate if other controllers are responsible for the processing of personal data in individual cases.

2. Terms and Legal Bases

2.1 Terms

Personal data means any information relating to an identified or identifiable natural person. A data subject is an individual whose personal data we process.

Processing includes any handling of personal data, irrespective of the means and procedures used, for example querying, comparing, adapting, archiving, retaining, reading, disclosing, obtaining, recording, collecting, deleting, revealing, arranging, organising, storing, modifying, distributing, linking, destroying and using personal data.

2.2 Legal Bases

We process personal data in accordance with Swiss data protection law, in particular the Federal Act on Data Protection (FADP) and the Ordinance on Data Protection (Data Protection Ordinance, DPO).

3. Type, Scope and Purpose

We process the personal data required to carry out our activities and operations on a permanent, user-friendly, secure and reliable basis. Such personal data may in particular include inventory and contact data, browser and device data, content data, metadata or peripheral data and usage data, location data, sales data as well as contract and payment data.

We process personal data for as long as required for the respective purpose or purposes or as required by law. Personal data that is no longer required for processing is anonymised or deleted.

We may have personal data processed by third parties. We may process personal data jointly with third parties or transfer personal data to third parties. Such third parties include, in particular, specialised providers whose services we use. We also ensure data protection when working with such third parties.

As a general rule, we process personal data only with the consent of the data subject. If and insofar as processing is permitted for other legal reasons, we may dispense with obtaining consent. For example, we may process personal data without consent in order to perform a contract, comply with legal obligations or safeguard overriding interests.

In this context, we process in particular information voluntarily provided to us by a data subject when contacting us – for example by post, email, instant messaging, contact form, social media or telephone – or when registering for a user account.

We may store such information, for example, in an address book, a Customer Relationship Management system (CRM system) or comparable tools. If we receive data about other individuals, the persons providing this data are required to ensure data protection in relation to those individuals and to ensure that the personal data is accurate.

We also process personal data that we receive from third parties, obtain from publicly accessible sources or collect in connection with our activities and operations, insofar as such processing is permitted for legal reasons.

4. Applications

We process personal data relating to applicants insofar as this is necessary to assess their suitability for employment or for the subsequent performance of an employment contract.

The required personal data results in particular from the information requested, for example in connection with a job advertisement. We also process personal data voluntarily disclosed or published by applicants, in particular as part of cover letters, CVs, other application documents and online profiles.

5. Personal Data Abroad

We generally process personal data in Switzerland. However, we may also disclose or export personal data to other countries, in particular in order to process it there or have it processed there.

We may disclose personal data to all countries and territories on Earth as well as elsewhere in the universe provided that the applicable law ensures adequate data protection in accordance with a decision of the Swiss Federal Council.

We may disclose personal data to countries whose laws do not provide adequate data protection, provided that appropriate data protection is ensured by other means. Appropriate data protection may, for example, be ensured through contractual agreements, standard data protection clauses or other suitable safeguards.

In exceptional cases, we may export personal data to countries without adequate or appropriate data protection if the specific requirements of data protection law are met, for example where the data subject has expressly consented or where there is a direct connection with the conclusion or performance of a contract. Upon request, we will provide data subjects with information about any safeguards or provide a copy of such safeguards.

6. Rights of Data Subjects

6.1 Data Protection Rights

We grant data subjects all rights under applicable data protection law. Data subjects have, in particular, the following rights:

  • Access: Data subjects may request information as to whether we process personal data relating to them and, if so, which personal data is involved. Data subjects also receive the information required to exercise their data protection rights and ensure transparency. This includes the processed personal data itself as well as, among other things, information about the purpose of processing, the retention period, any disclosure or export of data to other countries and the origin of the personal data.
  • Correction and restriction: Data subjects may have inaccurate personal data corrected, incomplete data completed and the processing of their data restricted.
  • Deletion and objection: Data subjects may request the deletion of personal data (“right to be forgotten”) and object to the processing of their data with effect for the future.
  • Data disclosure and data portability: Data subjects may request the disclosure of personal data or the transfer of their data to another controller.

We may postpone, restrict or refuse the exercise of data subjects' rights within the limits permitted by law. We may inform data subjects of any requirements that must be met in order to exercise their data protection rights.

For example, we may refuse access in whole or in part with reference to trade secrets or the protection of other individuals. We may also refuse the deletion of personal data in whole or in part with reference to statutory retention obligations.

In exceptional cases, we may charge costs for the exercise of such rights. We will inform data subjects in advance of any such costs.

We are required to identify data subjects who request access or exercise other rights using appropriate measures. Data subjects are required to cooperate in this identification process.

6.2 Right to Lodge a Complaint

Data subjects have the right to enforce their data protection rights through legal proceedings or lodge a complaint with a competent data protection supervisory authority.

The supervisory authority for private controllers and federal bodies in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).

7. Data Security

We take appropriate technical and organisational measures to ensure a level of data security appropriate to the respective risk. However, we cannot guarantee absolute data security.

Access to our website is protected by transport encryption (SSL/TLS), in particular using Hypertext Transfer Protocol Secure (HTTPS). Most browsers indicate transport encryption by displaying a padlock symbol in the address bar.

Our digital communication – like digital communication in general – is subject to mass surveillance without cause or suspicion and other forms of surveillance by security authorities in Switzerland, elsewhere in Europe, the United States of America (USA) and other countries. We have no direct influence over the corresponding processing of personal data by intelligence services, police authorities and other security authorities.

8. Use of the Website

8.1 Cookies

We may use cookies. Cookies – both our own cookies (first-party cookies) and cookies from third parties whose services we use (third-party cookies) – are data stored in the browser. Such stored data is not necessarily limited to traditional text-based cookies.

Cookies may be stored temporarily in the browser as “session cookies” or for a defined period as permanent cookies. Session cookies are automatically deleted when the browser is closed. Permanent cookies have a defined storage period.

Cookies make it possible, among other things, to recognise a browser during a subsequent visit to our website and thereby, for example, measure the reach of our website. Permanent cookies may also be used for online marketing purposes.

Cookies can be disabled or deleted in whole or in part at any time using the browser settings. Without cookies, our website may not be fully available. We request active and explicit consent to the use of cookies where and to the extent required.

For cookies used for success and reach measurement or advertising, many services offer general opt-out options via AdChoices, the Network Advertising Initiative (NAI), YourAdChoices or Your Online Choices.

8.2 Server Log Files

For each access to our website, we may collect the following information insofar as it is transmitted by your browser to our server infrastructure or can be determined by our web server: date and time including time zone, Internet Protocol (IP) address, access status (HTTP status code), operating system including user interface and version, browser including language and version, individual subpage accessed on our website including the amount of data transferred, and the last website accessed in the same browser window (referer or referrer).

We store such information, which may also constitute personal data, in server log files. The information is required to provide our website permanently, in a user-friendly and reliable manner and to ensure data security and therefore, in particular, the protection of personal data – including through or with the assistance of third parties.

8.3 Tracking Pixels

We may use tracking pixels on our website. Tracking pixels are also known as web beacons. Tracking pixels – including those provided by third parties whose services we use – are small, usually invisible images that are automatically retrieved when our website is visited. Tracking pixels may collect the same information as server log files.

9. Social Media

We maintain a presence on social media platforms and other online platforms in order to communicate with interested individuals and provide information about our activities and operations. In connection with such platforms, personal data may also be processed outside Switzerland.

The General Terms and Conditions (GTC), terms of use, privacy policies and other provisions of the respective platform operators also apply. These provisions provide information in particular about the rights of data subjects directly in relation to the respective platform, including the right of access.

10. Third-Party Services

We use services provided by specialised third parties in order to carry out our activities and operations on a permanent, user-friendly, secure and reliable basis. Such services allow us, among other things, to embed functions and content into our website. When such content is embedded, the services used may, for technically necessary reasons, temporarily collect users' Internet Protocol (IP) addresses.

For necessary security-related, statistical and technical purposes, third parties whose services we use may process data relating to our activities and operations in aggregated, anonymised or pseudonymised form. This may include, for example, performance or usage data required to provide the respective service. In particular, we use:

  • Google services: Providers: Google LLC (USA) / Google Ireland Limited (Ireland) for users in the European Economic Area (EEA) and Switzerland.
  • Microsoft services: Providers: Microsoft Corporation (USA) / Microsoft Ireland Operations Limited (Ireland) for users in the European Economic Area (EEA), the United Kingdom and Switzerland.

10.1 Digital Infrastructure

We use services provided by specialised third parties to access the digital infrastructure required for our activities and operations. This includes, for example, hosting and storage services from selected providers. In particular, we use:

  • Hostpoint: Domain Registrar: Hostpoint AG (Switzerland).
  • METANET: Hosting; provider: METANET AG (Switzerland).
  • Microsoft Azure: Storage and other infrastructure; provider: Microsoft.

10.2 Automation and Integration of Apps and Services

We use specialised platforms to integrate and connect existing third-party apps and services. We may also use such “no-code” platforms to automate processes and activities involving third-party apps and services. In particular, we use:

  • Microsoft Power Automate including Microsoft Power Platform: Integrated application platform; provider: Microsoft.

10.3 Contact Options

We use services from selected providers to improve communication with third parties such as potential and existing customers.

10.4 Audio and Video Conferencing

We use specialised audio and video conferencing services to communicate online. For example, we may use them to hold virtual meetings or conduct online teaching and webinars. The legal documents of the respective services, such as privacy policies and terms of use, also apply to participation in audio and video conferences.

Depending on the situation, we recommend muting the microphone by default when participating in audio or video conferences and blurring the background or using a virtual background. In particular, we use:

  • Microsoft Teams: Platform for audio and video conferencing, among other functions; provider: Microsoft.
  • Skype: Audio and video conferencing.
  • Zoom: Video conferencing; provider: Zoom Video Communications Inc. (USA).

10.5 Maps

10.6 Digital Audio and Video Content

We use services from specialised third parties to enable the direct playback of digital audio and video content such as music or podcasts. In particular, we use:

  • YouTube: Video platform; provider: Google.

10.7 Fonts

We use services from third parties to embed selected fonts, icons, logos and symbols on our website. In particular, we use:

  • Google Fonts: Fonts; provider: Google.

10.8 Advertising

We use the possibility to display targeted advertising for our activities and operations through third parties such as social media platforms and search engines.

With such advertising, we aim in particular to reach individuals who are already interested in our activities and operations or who may be interested in them (remarketing and targeting). For this purpose, we may transmit relevant information – potentially including personal data – to third parties that enable such advertising.

We may also determine whether our advertising is successful, in particular whether it leads to visits to our website (conversion tracking).

Third parties with whom we advertise and with whom you are logged in as a user may be able to associate your use of our website with your profile on their platform. In particular, we use:

  • Facebook Ads: Social media advertising; providers include Meta Platforms Ireland Limited (Ireland) and other Meta companies.
  • Google Ads: Search engine advertising; provider: Google.
  • Instagram Ads: Social media advertising; providers include Meta Platforms Ireland Limited (Ireland) and other Meta companies.
  • LinkedIn Ads: Social media advertising; providers: LinkedIn Corporation (USA) / LinkedIn Ireland Unlimited Company (Ireland).
  • Microsoft Advertising: Search engine advertising on Bing, DuckDuckGo and Yahoo!; provider: Microsoft.

11. Success and Reach Measurement

We seek to determine how our online offering is used. In this context, we may measure the success and reach of our activities and operations as well as the impact of links from third parties to our website.

We may also test and compare how different parts or versions of our online offering are used (“A/B testing”). Based on the results of success and reach measurement, we may in particular correct errors, strengthen popular content and improve our online offering.

For success and reach measurement, the Internet Protocol (IP) addresses of individual users are generally stored. In such cases, IP addresses are generally shortened (“IP masking”) in accordance with the principle of data minimisation through pseudonymisation.

Cookies may be used for success and reach measurement and user profiles may be created. Any user profiles created may include, for example, individual pages visited or content viewed on our website, information about screen or browser window size and at least an approximate location.

Any user profiles are generally created exclusively in pseudonymised form and are not used to identify individual users. Certain third-party services where users are logged in may associate use of our online offering with the respective user account or user profile.

In particular, we use:

  • Google Analytics: Success and reach measurement; provider: Google; including measurement across different browsers and devices (cross-device tracking).

12. Final Provisions

We may amend and supplement this Privacy Policy at any time. We will provide information about such amendments and supplements in an appropriate manner, in particular by publishing the current version of the Privacy Policy on our website.
